By opting in to deliver your Recordings on the Snap service, which includes all online properties owned and operated by Snap, Inc. ("Snap"), including, without limitation, Snapchat, Bitmoji and Zenly, ("Snap Service"), you represent and warrant that you own and control all rights in and to the musical compositions embodied in your Recordings ("Compositions").

The Snap Service enables Snap users to create and edit text and multimedia messages ("Messages") by including filters, animations, effects, text captions or drawings using Snap's creative tools, which include for example Lenses, Filters, and Bitmojis. Snap's music feature on the Snap Service includes a free-to-user library of sound recordings embodying musical works and lyrics and associated artwork (the "Library"). Snap and its users will be able to incorporate up to sixty (60) seconds of a sound recording and associated artwork into visual (or other) elements and effects created using the Snap Service ("Music Library Elements"). Snap users will be able to incorporate Music Library Elements and/or up to sixty (60) seconds of a sound recording and associated artwork from the Library into their Messages ("Music Library Messages"). Any Messages that are not Music Library Messages are called "Other Messages" and any elements or effects that are not Music Library Elements are called "Other Elements."

You agree to license your Compositions to DistroKid for all uses necessary to make such Compositions available as part of the Snap Service on a worldwide basis, including, without limitation, to reproduce, stream, distribute, display, publicly perform and otherwise make your Compositions (and associated lyrics) available to Snap and its users in order to preview your Compositions, embody your Compositions in Messages and Music Library Elements for use on and off the Snap Service, to edit Messages and Music Library Elements embodying your Compositions and to share, display, stream and otherwise use Messages and Elements embodying your Compositions on the Snap Service and/or the users' local devices.

You also agree not to (whether during or after the period within which your Recordings and Compositions are distributed by DistroKid ["Distribution Term"]) directly or indirectly bring, assert, join in, support, or otherwise participate in any claims, causes of action, suits, controversies or demands against Snap and/or its subsidiaries, affiliates, or personnel (past or present) arising from, based on, or in connection with, in whole or in part, use of your Recording and Compositions in connection with the creation by Snap users of Other Messages or Other Elements and/or the use of Other Messages or Other Elements via the Snap Service during the Distribution Term.

In the event you are affiliated with a performing rights society, performing rights organization or other collection society ("PRO") to which you have granted the non-exclusive right to administer the public performance rights in and to your Compositions, you agree to notify each such PRO, in accordance with the requirements of your applicable PRO membership agreement(s), of your agreement to grant a direct public performance license in connection with this opt-in notice

All of the representations and warranties you've made in the DistroKid Distribution Agreement shall apply to this opt-in notice and your Compositions. Nothing herein shall limit the DistroKid Distribution Agreement in any way.
